1. United Coil Center Limited's privacy statement

This privacy notice (the "Privacy Notice") prescribes how United Coil Center Limited ("UCC," "we," "our," or "us") collects, uses, and discloses (collectively, "processes") your Personal Data, whether this Personal Data pertains to you as a customer, prospective customer, supplier, prospective supplier, contact person or representative or personnel of those persons, or government official ("you" or "your") as UCC recognizes and respects the privacy of your Personal Data. In addition, UCC will exert all possible efforts to ensure that all UCC personnel will comply with this Privacy Notice.

This Privacy Notice applies to all communication channels, both online and offline, whether face-to-face, over the phone, or via any other means used in communications for any activities, unless another specific privacy policy is prepared.

This Privacy Notice may be periodically updated to reflect changes in the personal data protection law, other applicable laws, and our practice. UCC will indicate the date and version of the Privacy Notice at the top for your ease of reference. UCC highly recommends that you revisit this Privacy Notice periodically to learn of any changes. If any changes require your consent under the applicable laws, we will obtain your consent beforehand.

2. Definition of Personal Data

"Personal Data" means any information relating to a person that enables the identification of that person, whether directly or indirectly.

3. Personal Data collected by UCC

UCC collects your Personal Data that is provided by you, collected in the process of providing goods and services to corporate customers, provided by any third parties, or obtained from external sources. Your Personal Data to be collected includes but is not limited to the following:

  • your name, surname, gender, age, date of birth, job information, job position, signature, car license plate number, bank account information, photographs and videos of you, national identification card data, passport data, household registration data, drivers license data or data in other types of identity document issued by a government (excluding the Sensitive Information), and any other information that is able to identify your identification (collectively, "Identification Information");
  • your personal or business phone number, mobile number, fax number, address, and email address, as well as your social media profile (collectively, "Contact Information");
  • your business proceedings or undertakings with UCC, including but not limited to your agreement information, service or products purchased, contact history, company directors and shareholders, comments, questions, inquiries, feedback, or survey responses (collectively, "Transaction Information"); and
  • your religion, race, or blood type (collectively, "Sensitive Information").

If you provide UCC with any Personal Data of other persons, you are obliged to ensure and warrant that you have the authority to do so in accordance with this Privacy Notice.

UCC's activities are generally not aimed at any person who is a minor. If UCC learns that UCC has collected Personal Data of any minor, UCC will proceed to comply with the applicable law promptly. If you are a minor and consent for UCC to process your Personal Data, you must indicate that your parent or guardian has consented to you doing so.

4. Legal bases

Your Personal Data will be processed for the Purposes below by UCC on the legal bases, e.g. your consent, contractual obligation, UCC's legitimate interest, legal obligation, vital interest, and the establishment and defense of legal claims.

You are able to withdraw your consent as described in section 10 below if UCC processes your Personal Data based on your consent.

5. Processing of your Personal Data

Your Personal Data is required for the Purposes below. Otherwise, UCC may not be able to undertake any intended actions with you. UCC processes your Personal Data for purposes including but not limited to the following (collectively, the "Purposes").

  • Business transaction purpose

Your Identification Information, Contact Information, and Transaction Information are processed on a contractual obligation basis in order to determine whether to enter agreements with you, order products or services, provide quotations, contact your company regarding agreements, perform contractual obligations, provide products and services for your company, analyze and prepare information for purchase orders, manage deliveries and shipments, manage payments, provide after-sale services, facilitate transactions, administer product returns, verify identity, and for other contractual undertakings.

  • Provision of information purpose

Your Identification Information, Contact Information, and Transaction Information are processed on UCC's legitimate interest basis in order to analyze and response with your comments, questions, inquiries, or feedback, provide you with information related to our products and services, provide up-selling information or advertisements or promotions, contact for governmental purposes, and provide other relevant information of terms and conditions, this Privacy Notice, or other related documents to you.

  • UCC operation purpose

Your Identification Information, Contact Information, and Transaction Information are processed on UCC's legitimate interest basis in order to manage and improve our business operations, conduct audits, manage internal business compliance, implement terms and conditions, the Privacy Notice, and relevant documents, conduct and analyze market research, develop products and services, analyze the efficiency of promotions and advertisements, customize our strategy, analyze both online and offline communication channels, enhance online security, and for other UCC's operation.

  • Legal compliance purpose

Your Identification Information, Contact Information, and Transaction Information are processed on a legal obligation basis in order to act in accordance with UCC's legal obligations and rights under the applicable law, establish, comply with, exercise, or defend against legal claims in the future, and for other legal compliance purposes.

  • Security purpose

Your Identification Information, especially video of you as captured by CCTVs, are processed on UCC's legitimate interest basis in order to maintain UCC's security system.

  • Identification and record purpose

Your Sensitive Information as shown in your national identification card, passport, household registration, driving license, and other types of identity document issued by governments may be processed on your consent in order to authenticate and verify your identity, and to keep as records and evidence (collectively "Identification and record").

6. Personal Data security

UCC adopts the appropriate physical and electronic security measures to store your Personal Data and prevent it from being accidentally lost, used or accessed without authorization, damaged, destroyed, altered, or disclosed. The physical security measures include locked lockers or access-controlled premises. The electronic security measures include limited access-control and antivirus protection. UCC will also promptly take corrective actions upon the occurrence of a security incident.

7. Disclosure of Personal Data

For the above Purposes, UCC may disclose your Personal Data to our parent company, affiliates, subsidiary companies, group companies, business partners, service providers, suppliers, customers, sub-contractors, external advisors, auditors, or any other third parties, whether private or governmental. UCC ensures that those who receive your Personal Data will have adequate personal data security standards according to the applicable law.

UCC may also disclose, share, or transfer any of your Personal Data in our possession if UCC sells or transfers all or a portion of our business or assets, including but not limited to in a merger, acquisition, amalgamation, or joint venture.

8. Cross-border transfer

UCC may disclose, share, and transfer your Personal Data to outside Thailand for the Purposes above from time to time. In such a case, UCC will seek your explicit consent and ensure that those who have received your Personal Data will have adequate personal data security standards under the applicable law.

9. Retention period

UCC will retain your Personal Data for only as long as reasonably necessary to fulfill our duties to achieve the Purposes described in this Privacy Notice. If a judicial or disciplinary action is initiated, your Personal Data may be stored until this action ends, including during any potential period for appeal, and will then be deleted or archived, as permitted by applicable law.

10. Your rights

You have the rights regarding your Personal Data as described below. Please contact UCC as provided in section 11 below if you wish to exercise any of these rights. UCC may require you to prove your identity before complying with your request or exercise of rights in order to protect your own privacy and security.

  • You have the right to access or request copies of your Personal Data. UCC will only provide you with access to the Personal Data contained in the documents requested, and not to the full documents themselves.
  • You have the right to rectify your incomplete, inaccurate, misleading, or out-of-date Personal Data.
  • You have the right to obtain your Personal Data you have given to UCC or to request the transfer of your Personal Data to any third parties if such Personal Data is processed on your consent or on a contractual basis.
  • You have the right to object to the collection, use, or disclosure of your Personal Data in certain cases, including but not limited to objecting to the processing for direct marketing purposes.
  • You have the right to request that UCC delete, destroy, or anonymize your Personal Data in certain cases, including but not limited to when the Personal Data is no longer necessary for the Purposes, or when your Personal Data has been unlawfully collected, used, or disclosed.
  • You have the right to request that UCC restrict our use of your Personal Data in certain cases, including but not limited to: (i) when UCC is considering a request you have made to object to the processing of your Personal Data; (ii) when you have requested that UCC retain Personal Data that would otherwise be destroyed or deleted, and that UCC instead restricts its use; or (iii) when your Personal Data is no longer necessary, but UCC cannot delete it because you have requested that UCC retain it for the establishment of, compliance with, exercise of, or defense against legal claims.
  • You have the right to withdraw your consent regarding your Personal Data granted to UCC at any time.
  • You have the right to submit complaints to relevant data protection authorities if UCC has failed to comply with the applicable law.

UCC will try to respond all requests to exercise the above rights within 30 days. However, it may take us longer than a month if your request is particularly complex. UCC generally does not charge any fee for the exercise of the above rights unless your request is unfounded, repetitive, or excessive.
